Right to reside an interest in possession? Beware, this decision may change your view

Join us for an interesting presentation by Kate Selway KC, who appeared for the successful appellant in the recent and much-discussed First-tier Tax Tribunal case Hall & another v HMRC[2023] UKFTT32.

The matter concerned the estate of Mrs Raboni and whether Mr Boggia, a beneficiary named in her will, had an interest in possession of the property he resided in after her death when there were insufficient funds in the residuary estate to pay the inheritance tax.

Kate Selway KC is in practice at Radcliffe Chambers and has a wide-ranging and highly successful commercial and traditional chancery practice.

An experienced litigator, she has appeared in a number of high-profile cases and has represented numerous government departments and agencies while on the Attorney General’s Panels. She is known for her clear, concise, and pragmatic approach and has been described as “Approachable, down-to-earth and extremely knowledgeable” (Charities, Chambers UK Bar 2023), “Wonderfully responsive and collaborative” (Private Client: Trusts and Probate, Legal 500 UK Bar 2023) and “Absolutely terrific” (Chancery: Traditional, Chambers UK Bar 2022).

Her core areas of practice are trusts (including the taxation of trusts); all aspects of real property, and landlord and tenant; wills, probate, and the administration of estates; charities; Court of Protection; and professional negligence. She was appointed to the Attorney General’s A Panel of Counsel in 2016 and took silk in 2020.
